Phuket Tour Operator Licence 2026: TAT Registration, Guide Rules & Compliance Costs

The Tourism Authority of Thailand doesn't mess around — here's how to get properly licensed before your first tour departs.

Phuket's tourism economy is built on day trips — Phi Phi Islands, Phang Nga Bay, Similan Islands, James Bond Island, Elephant Hills, Elephant Sanctuary. Millions of tourists pass through the island's tour desks every year. And behind every legitimate tour is a TAT licence, a licensed Thai guide, and a compliance stack that most people who start a Phuket tour company haven't thought through before taking their first booking.

TAT (Tourism Authority of Thailand) inspectors are active in Phuket. They run spot checks at pier departure points, contact hotel concierges, and monitor online booking platforms. Operating unlicensed tours risks fines up to THB 50,000 and the permanent closure of your business. Getting licensed is not difficult — it's just a process that requires the right structure and a bit of patience.

Key Facts: Phuket Tour Operator Licensing

The Three Tour Operator Licence Types

Type A: Outbound Tourism

Type A covers businesses sending Thai nationals abroad as tourists. Requires a bond of THB 600,000 and is not relevant to most expat-founded Phuket tour companies focused on inbound tourism.

Type B: Inbound and Domestic Tourism

This is the licence most Phuket tour companies need. Type B covers: organising tours within Thailand for foreign visitors, running day trips, excursions, transfers with tour elements, and domestic travel packages. It requires a bond of THB 200,000, paid-up capital of at least THB 1 million, qualified staff, and physical office premises in Phuket. The TAT Phuket Region 5 Office (on Chalermprakiat Road near Phuket Town) handles applications for Phuket-based operators.

Travel Agent Registration

If you are acting as a reseller of other operators' packages rather than operating tours yourself, you may be eligible for Travel Agent registration rather than a full Tour Operator licence. This has lower capital requirements but more limited operational scope. Many Phuket hotel concierge desks and activity desks operate under this category.

The Tour Guide Rule: What Foreigners Cannot Do

This is the rule that creates the most frustration for expat tour company founders. Under Thai law, guiding tourists — providing commentary, leading groups, interpreting cultural and historical information — is an occupation reserved for Thai nationals. A foreign national cannot hold a Thai tour guide licence (ใบอนุญาตมัคคุเทศก์), full stop. TAT inspectors check guide ID cards at departure points, particularly at Chalong Pier, Rassada Pier, and Ban Rong Pier in Bang Tao. Getting caught with an unlicensed guide — Thai or foreign — results in fines for both the operator and the individual.

What this means in practice: every guided tour your company runs in Phuket must have a licensed Thai guide on board. You can design the tour, sell it, operate the logistics, and own the business. But the person holding the microphone on the speedboat explaining the geology of Phang Nga Bay must be a licensed Thai guide. Build your guide team before you build your booking calendar.

⚠ The "No Guide Needed" Misconception: Some operators believe that if they position their tours as "self-guided" or "transfer with commentary" they can avoid the guide licensing requirement. TAT does not accept this distinction for most commercial tour activities. If you are providing any form of interpretation, local information delivery, or structured group activity commentary, you need a licensed guide. When in doubt, ask the TAT Phuket Office directly.

TAT Licence Application Process

Step 1: Company Setup

Before applying for your TAT licence, you need a registered Thai company with tourism/travel agency services in your business objects. Tourism is FBA-restricted, so most operators use a Thai-majority structure (49% foreign / 51% Thai). Minimum paid-up capital for Type B: THB 1 million. See our guide on company registration in Phuket for the full process.

Step 2: Secure Physical Office Premises

TAT requires a physical office for your tour operation — a virtual office address is not sufficient. The office must be in a commercially-zoned building. A small office near Phuket Town or Rawai typically rents for THB 8,000–20,000/month. You'll need to provide a lease agreement as part of your TAT application.

Step 3: Post the Bond

Type B operators must post a THB 200,000 bond with the TAT Tourism Business Division. This is done through a government-approved bank guarantee or cash deposit. The bond protects consumers against tour operator default. It is returned (with interest) when you close or surrender your licence.

Step 4: Submit Application to TAT Phuket

The application package includes your company registration documents, office lease, evidence of paid-up capital, staff qualifications, sample tour itineraries, insurance certificate, and completed TAT application forms. The TAT Phuket Region 5 Office on Chalermprakiat Road in Phuket Town processes applications. Allow 4–8 weeks for initial approval. Annual renewal is required.

💡 Insider Tip: Build OTA Relationships Early

Phuket's major booking channels — Viator, GetYourGuide, Klook, and the island's own property-linked concierge networks — require proof of TAT licensing before listing your tours. Starting the TAT application process at least 3 months before your planned launch date gives you time to secure your licence and complete platform onboarding simultaneously. Several Phuket operators lose their first high-season window because they started the process too late.

Frequently Asked Questions

What is a TAT licence and does my Phuket tour company need one?

A TAT licence is required for any business providing tour programs, travel packages, or guided excursions in Thailand. It is issued under the Tourism Business and Guide Act B.E. 2551 (2008). Any company selling, organising or leading tours in Phuket must be registered with the TAT Tourism Business Division. Operating tours without a TAT licence carries fines of up to THB 50,000.

Can a foreigner own a tour company in Phuket?

Tour operations are listed in Schedule 3 of the Foreign Business Act as restricted service businesses. A foreigner cannot own the majority of a licensed tour company without a Foreign Business Licence. Most expat-founded Phuket tour companies operate under Thai-majority structures (51% Thai, 49% foreign).

Can a foreigner be a tour guide in Phuket?

Tour guiding is specifically listed as an occupation reserved for Thai nationals. Foreigners cannot hold a Thai tour guide licence and cannot legally work as tour guides in Thailand, even for their own tour company. Foreign tour operators must hire Thai licensed guides for all guided tour activities.

How much does a TAT tour operator licence cost in Phuket?

The TAT tour operator licence (Type B) costs approximately THB 10,000–20,000 in government fees, plus a bond of THB 200,000. Total first-year compliance cost for a small Phuket tour company including company registration, guide employment, and insurance is approximately THB 350,000–600,000.

What types of tour operator licences exist for Phuket?

There are three main types. Type A covers outbound tourism (requires THB 600,000 bond). Type B covers inbound and domestic tourism (requires THB 200,000 bond) — most common for Phuket day trip operators. Travel Agent registration is available for resellers who do not operate tours directly.

Do I need insurance to run tours in Phuket?

Yes. TAT requires tour operators to have public liability insurance covering clients during tour activities. For water-based activities this is particularly strictly enforced. Budget THB 30,000–80,000/year for a basic tour operator liability policy in Phuket. Boats used in your tours need their own Marine Department licences and insurance.
